Competition Terms and Conditions
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE.
1. Who We Are and How to Contact Us
1.1 The promoter is: WTF GIVEAWAYS LTD with Company Number 17038774 and whose registered office is at 16 Green Drive, Thornton-Cleveleys, United Kingdom, FY5 1LQ ("we", "us", "our", or "WTF Giveaways").

2. Applicability and Acceptance
2.1 These competition terms and conditions ("Competition T&Cs"), together with:
- (a) our website terms of use ("Terms of Use");
- (b) any terms and conditions that apply to specific competitions (the "Specific Rules"); and
- (c) the terms and conditions that apply to any promotion that we offer (the "Promotional Terms"),
(the Competition T&Cs, the Terms of Use, the Specific Rules, and the Promotional Terms being together referred to as the "Terms and Conditions") apply to your use of the Services (as defined in paragraph 2.2 below).
2.2 The Terms and Conditions apply to you whenever you use our website at www.wtf-giveaways.co.uk (the "Website"), register for an Account (as defined in paragraph 2.3 below), enter into any Competition, participate in any of our promotions (including any bonus offers or when using any discount codes), win any prize (including website credits ("Site Credits") which are virtual balances that can be used on the Website to enter into Competitions but cannot be withdrawn, redeemed for cash, or used in any way other than to enter Competitions), engage with any of our social media pages, groups or accounts, or otherwise use, access and/or interact with any of the products or services offered by us (together the "Services").
2.3 By using the Services, you agree to enter into a legally binding agreement with WTF Giveaways on the terms set out in the Terms and Conditions. If you do not agree with any of the Terms and Conditions, you must not register for an account with us via our Website (an "Account") and you must stop using the Website and our Services.
2.4 If there is any conflict or inconsistency between these Competition T&Cs, the Terms of Use, the Specific Rules, and/or the Promotional Terms, the order of priority in which they shall apply will be: these Competition T&Cs, the Terms of Use, the Specific Rules, then the Promotional Terms.
3. Changes to the Terms and Conditions
We may make important changes to the Terms and Conditions from time to time. If we make any such important changes to the Terms and Conditions, we will provide notice to you (via a pop-up notice on the Website) before the changes come into effect. You will be required to accept these important changes in order to continue to use the Website. If you do not agree to the changes that are made, you must stop using the Website and close your Account.
4. Your Account
4.1 If you want to use our Services, enter into any Competition (whether you pay to enter or enter for free by post (see paragraph 6.13 below for more details about the postal entry route)) or participate in any of our promotions, you must first register for an Account. Please see our Terms of Use for more information about your obligations with respect to your Account.
4.2 If your personal details, including your contact information, change at any time then you should notify us as soon as reasonably possible. Such changes should be made through your Account or notified to us via email to info@wtf-giveaways.co.uk. Any notification to us must include details of any Competition(s) you have entered, your old details and your new details. If your details change within 10 calendar days before the Closing Date of any Competition, we will use your old details if we need to contact you.
4.3 You have the right to close your Account and cease using the Services at any time but you will remain responsible for all activities conducted from your Account until it is closed and/or deleted and/or you cease using the Services. We will maintain your Account for a period of time following the Account closure in order to assist us in complying with our legal and regulatory obligations and in accordance with our Privacy Notice.
4.4 While there is no legal or regulatory requirement for us to do so, we have made spend limit and self-exclusion tools available for use on your Account. Further details of the spend limits and self-exclusion tools that we implement are available on the Website. You accept and agree that we are not responsible, and will not be liable to you in any way, if you exceed or circumvent your spend limit or if you start using our Services again after you have self-excluded.
5. The Competitions
5.1 We may offer different types and/or formats of prize competition from time to time (the "Competitions") which will be drawn at random (see paragraph 7 below for more details on how winners are selected), including the following:
(a) Main Competitions
All of our "Main Competitions" will have a choice of whether to participate by paying to enter or to enter for free by post for the opportunity to win one of the prizes advertised on our Website. Our Main Competitions may also include additional Instant Win prizes (see paragraph 5.1(b) below) and may also utilise the 'auto-draw' system which will award an additional prize automatically when the draw closes (see paragraph 7.2 below).
(b) Instant Wins
Where we offer "Instant Win" prizes for certain Competitions, you will also be able to pay to enter or to enter for free. You will be allocated a ticket number in respect of your entry(ies) and if any of your ticket numbers match a randomly pre-determined Instant Win ticket number, then you will immediately be notified that you have won the relevant Instant Win prize. Some Instant Win prizes may be won as part of a Main Competition (in which case, your ticket(s) will be eligible to win prizes in the associated Main Competition, in addition to the specific Instant Win prize that has been advertised). Certain Competitions that offer Instant Win prizes may also utilise the auto-draw system, in which case there will be an Instant Win prize and another prize which will be drawn automatically when the Competition closes. When you participate in any Competition which offers Instant Win prizes, you will be able to see which prizes have been won and which have already been claimed before you enter.
(c) Free Draws
Where we offer a "Free Draw", you will only be able to enter for free via the Website (so there is no additional free postal entry route). Depending on the specific terms of the Free Draw, Instant Win prizes and prizes determined by the auto-draw system may also be available.
5.2 Some of our Competitions may be broadcast 'live' via our social media pages, which will be clearly stated in the prize description for the relevant Competition on the Website.
5.3 We may give away free rewards, perks, or other incentives from time to time. These are provided solely as goodwill gestures for promotional, entertainment, or engagement purposes. These rewards are not, and should not be interpreted as, compensation for employment and do not give rise to any contractual obligation, or a promise of or entitlement to future payments. Participation in these offerings does not establish any form of employment relationship, job contract, or ongoing financial commitment between you and us. Facebook or any other third-party platform is not involved in or responsible for these rewards, nor do they constitute any form of contract or obligation on behalf of the platform.
5.4 We reserve the right to withdraw, void, suspend, remove, cancel, modify or amend any type or format of Competition or promotion, or any other aspect of the Services and any associated terms and conditions at any time. It will be necessary for us to take this course of action in certain circumstances, including if there is a clear and obvious error with any information published in relation to any Competition or promotion, or if any fraud, technical or system failures, or any other factor beyond our reasonable control impairs our ability to offer any Competition, promotion, or other aspect of the Services.
5.5 There is no minimum number of entries required in relation to any Competition and we will not hold, void, suspend, cancel, or amend any Competition or extend the Closing Date solely due to a lack of entries. Subject always to paragraph 5.4, the draw will take place and the prize will be awarded even if the maximum number of entries for that Competition has not been received.
6. How to Enter
6.1 Each person who validly enters our Competitions or participates in our promotions is referred to in these Competition T&Cs as an "Entrant".
6.2 Each Competition will run from and including the opening date to the closing time and date specified on the Website. These dates shall be referred to in these Competition T&Cs as the "Opening Date(s)" and "Closing Date(s)" respectively. For all our Competitions, a timer counting down to a specified time on the Closing Date will also be displayed on the Website. All times and dates referred to are the times and dates in London, England.
6.3 If it is necessary to do so, we reserve the right to change the Opening Dates and Closing Dates. If we do change the Opening Date and/or the Closing Date of a Competition, the new details will be displayed on the Website. We will never extend the Closing Date simply to sell more entries.
6.4 All Competition entries must be received by us by no later than the specified time on the Closing Date. Any entries received after the specified time on the Closing Date will be voided and no refunds for any entry fees, costs, other fees or expenses incurred, or the return of any Site Credits or promotional offers used, in connection with such entry(ies) will be given.
6.5 If there is a maximum number of entries into a Competition, this will be stated on the Website, together with a counter (and/or percentage bar) showing how many of the total tickets available have been sold and/or entries received. However, the counter (and/or percentage bar) should not be considered as final and complete (unless it shows that the maximum number of tickets have been sold) as any eligible free postal entries may still need to be processed and certain entries may have been voided or removed from the draw in accordance with the Terms and Conditions.
6.6 You can enter a Competition as many times as you wish (except for Free Draws and certain specified Competitions with a postal entry route, which are limited to one entry per person) until the maximum number of entries available for the relevant Competition have been received. Any entries received after the maximum number of total entries specified in relation to a Competition is reached will be voided and no refunds for any entry fees, costs, other fees or expenses incurred, or the return of any Site Credits or promotional offers used, in connection with such entry(ies) will be given.
6.7 You acknowledge and accept that the price of entry into our Competitions is determined in our sole discretion and will be specified at the point of sale and/or displayed on the relevant page(s) of the Website.
6.8 Payment for entries can be made by the payment methods specified on the relevant page(s) of the Website. Some banks may impose charges or fees for making transactions in connection with your purchase and such charges may vary between banks or financial institutions; please check with your bank for more details as you will be solely responsible for any such charges.
6.9 Once you have opened your Account, to enter a Competition:
- (a) go to the Website and choose which Competition you would like to enter; and
- (b) either:
- (i) select the number of tickets that you wish to purchase, add them to your basket, apply any Site Credits and/or promotional offers (if applicable), proceed to checkout, and complete the purchase; or
- (ii) enter for free by post in accordance with the terms displayed on the Website and these Competition T&Cs.
6.10 All entries must be submitted in the English language. Entries in languages other than English will automatically be voided and no refunds for any entry fees, costs, other fees or expenses incurred, or the return of any Site Credits or promotional offers used, in connection with such entry(ies) will be given.
6.11 We will send confirmation via email and to your Account that your purchase has been completed and your entry has been received.
6.12 We will not accept responsibility and will not be liable to you for entries that are not successfully completed or purchased (for example due to a failed payment) or that are lost, damaged, delayed, destroyed, incomplete, unintelligible, misdirected, technically corrupted, or for other submission issues of any kind, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction (by you or our systems), acts of god or any network, server, computer hardware or software failure of any kind. No refunds for any entry fees, costs, other fees or expenses incurred, or the return of any Site Credits or promotional offers used, in connection with such entry(ies) will be given.
6.13 You may enter any Competition via the postal entry route for free (save for Free Draws where entries can only be made via the Website) by complying with the following conditions:
- (a) send your entry(ies) by ordinary first or second class post (without special arrangements for delivery) on an unenclosed postcard to us at the following address: WTF Giveaways, 16 Green Drive, Thornton-Cleveleys, United Kingdom, FY5 1LQ;
- (b) hand delivered entries will not be accepted and will not be entered into the relevant Competition;
- (c) include with your entry the following information:
- (i) your full name;
- (ii) your residential address;
- (iii) a contact telephone number and the email address linked to your Account;
- (iv) your date of birth; and
- (v) the name of the Competition you are entering;
- (d) the information that you provide in respect of paragraphs 6.13(c)(i)–(c)(iv) above must correspond to the details on your Account;
- (e) incomplete or illegible entries will be voided;
- (f) you may make multiple free postal entries for any Competition (except where there is a limit on such entries per Entrant as will be displayed on the Website (and in some instances this may be limited to one) and subject always to the maximum total number of entries available for the Competition as displayed on the Website), but each free postal entry must be submitted and posted to us separately. Bulk postal entries combined in one envelope/package will not be accepted as multiple entries and if such a bulk entry is received, it will be counted as one single entry into one Competition only;
- (g) we will not take into account any proof of posting as this is not relevant to determining the time or date on which we actually receive the postal entry and it does not guarantee that you will be entered into the random draw;
- (h) if the total number of entries received by us reaches the maximum number of total entries specified on the Website before your free entry(ies) is/are received, your entry will be automatically voided, it will not be entered into the Competition, and no refunds for any entry fees, costs, other fees or expenses incurred in connection with such entry(ies) will be given.
7. Selecting the Winners
7.1 All Entrants will be entered into the relevant Competition and the winner (or winners if there is more than one prize) will be chosen at random using third party random number generator software. Except as provided in these Competition T&Cs, the output of the random number generator is final. The system used to allocate prizes does not differentiate between those who participate by paying and those who participate for free (whether as a Free Draw or via the postal entry route).
7.2 We also use an auto-draw system to select the winning entry for certain Competitions. Where the auto-draw system is utilised, the random number generator will automatically select a winner from all valid entries as soon as the specified time on the Closing Date is reached or the maximum number of entries has been sold, whichever is sooner. The results from auto-draws are usually posted on our social media pages at a time that will be specified in the prize description for the relevant Competition on the Website.
7.3 For all Competitions, when a ticket number is produced by the random number generator, it will be checked to see if that ticket number has been allocated to a valid entry. If the ticket number has not been allocated to a valid entry, a re-draw will take place until a ticket number has been matched to a winning entry.
7.4 Where there is a 'live' draw conducted for certain Competitions, the draw will take place as soon as reasonably possible after the specified time on the Closing Date or the time at which the maximum number of entries has been received (whichever is sooner).
7.5 All Entrants will have their names and entry numbers included on a spreadsheet which may be visible during a 'live' draw. We will announce the winner's full name and entry number during a 'live' draw, however if you wish for your name to be censored then please contact info@wtf-giveaways.co.uk at least 48 hours before the specified time on the Closing Date.
7.6 We are required to either publish or make available information which indicates that a valid award took place. To comply with this obligation, we will either publish the prize winner's surname and county of residence on the Website or send this information to anyone who writes to the address set out in paragraph 1.1 making a request for such information. If you do not wish to have this information published or made available, you must contact us via email at info@wtf-giveaways.co.uk as soon as reasonably possible after you have completed your entry and in any event, at least 48 hours before the specified time on the Closing Date. In such circumstances, we must still provide the information to the Advertising Standards Authority on request.
8. Prizes
8.1 The prize(s) that may be won for each Competition or promotion will be described on the Website. Details of the prizes are, to the best of our knowledge, correct as at the Opening Date and WTF Giveaways shall have no liability to you for any incorrect information, including where there has been a clear and obvious error in the information published about the prize on the Website.
8.2 We may withhold and void the awarding of a prize to you for the following reasons:
- (a) where you fail to comply with the eligibility requirements provided in these Competition T&Cs;
- (b) if you fail to claim the prize in accordance with paragraph 9;
- (c) where you engage in any of the prohibited activities provided in paragraph 11.1;
- (d) where you initiate a chargeback or other reversal of payment which we (or the relevant acquiring bank) suspect is fraudulent or spurious in any way;
- (e) if, due to reasons of hardware, software or other computer related error, failure, bugs or the unintended operation of any technical systems or software, human error, or due to any other circumstances beyond our reasonable control, a prize is awarded to you incorrectly;
- (f) where any factor beyond our reasonable control impairs our ability to offer any aspect of the Services (including those circumstances detailed in paragraph 13.4); and
- (g) where there is a clear and obvious error in the information published about the prize on the Website.
8.3 Prizes are subject to availability. WTF Giveaways reserves the right to substitute any prize if the prize that was originally offered cannot be awarded. If any details of the advertised prize change, we will endeavour to update the Website as soon as reasonably possible.
8.4 WTF Giveaways makes no representations and gives no warranties, assurances or promises about the prizes, their value, their condition, their quality, or any other information relating to the prizes provided on the Website.
8.5 If the prize is a property:
- (a) we will pay your reasonable conveyancing costs and Stamp Duty Land Tax (if applicable) in connection with the transfer of the property to the winner;
- (b) where we advertise a property as furnished, all such fixtures, fittings and contents will remain at the property and become the property of the winner upon completion of the transfer of the property to the winner;
- (c) you are responsible for making your own enquiries as to your rights and eligibility to take ownership of the prize and your eligibility to enter or live in the country where the prize is located;
- (d) if, prior to the date of the transfer, the property is damaged or destroyed by an event that is covered under our property insurance policy, we will make a claim to our insurer, pay any necessary excess, and take reasonable steps to repair or reinstate the property as soon as reasonably practicable, subject to any necessary consents being obtained. We will not be liable for any damage or loss to the property arising from events that are not covered by our property insurance policy (an "Uninsured Risk") and we will not be responsible for repairing or reinstating the property for any damage or destruction resulting from an Uninsured Risk;
- (e) the winner of the prize will be required to enter into a transfer deed with either WTF Giveaways or the Supplier (as defined in paragraph 8.8 below) in order to transfer the legal title of the prize to the winner. If the winner refuses to sign or is unable to enter into any of the legal documents required to transfer ownership of the prize to the winner within a reasonable time, the winner will be disqualified from the Competition and the prize will be voided. WTF Giveaways will then be entitled to offer the prize to the next eligible person selected from the entries that were received before the Closing Date;
- (f) due to the nature of the prize, the date of transfer cannot be guaranteed but we will take reasonable steps to complete the transfer as soon as reasonably possible;
- (g) the winner will be responsible for all outgoings, utilities, taxes, charges, and any other costs, fees, or expenses associated with the property from the date of the transfer;
- (h) we reserve the right, in our sole discretion, to substitute any property with any alternative property of comparable value;
- (i) unless expressly stated otherwise, the property is awarded without any representations or warranties (other than those which cannot be excluded by applicable law); and
- (j) all risks associated with the property shall transfer to the winner on the date of the transfer deed and WTF Giveaways will be released of any future liability.
8.6 If the prize is a vehicle:
- (a) we will, unless otherwise stated, ensure it comes with a valid MOT (if required);
- (b) no insurance is included with the prize and it is the winner's responsibility to ensure the vehicle is adequately insured prior to taking it on the public roads (if it is legal to do so);
- (c) we will have no responsibility for the prize once it has been collected by the winner. The winner is solely responsible for complying with all relevant laws and regulations relating to the vehicle, its operation, and ensuring they operate it in a safe and responsible manner;
- (d) the winner is responsible for ensuring that any vehicle/road tax is duly paid before using the vehicle;
- (e) the winner is responsible for ensuring they have the necessary licences, qualification, knowledge and experience to operate the vehicle safely and legally; and
- (f) the winner is solely responsible for ensuring they have all necessary safety equipment and clothing (for example, helmets, boots and gloves) and for wearing them whilst operating the vehicle.
8.7 If the prize involves a travel component:
- (a) all travel must be undertaken strictly in accordance with the instructions provided by us in the prize description for the relevant Competition on the Website, including any specified itinerary;
- (b) where we have specified a maximum budget, this represents the upper limit of the entire value of the cost of the trip. The actual costs may vary based on booking times and other circumstances but the actual costs will never exceed the specified maximum budget;
- (c) if specific travel dates are stipulated by us and the winner cannot travel on these dates, the winner's entitlement to the prize may be voided and we reserve the right to offer the prize to the next eligible Entrant selected at random from the entries that were validly received before the Closing Date. We shall incur no liability towards you if your entitlement to any prize is voided in accordance with this paragraph 8.7(c);
- (d) travel and accommodation arrangements are subject to the terms, conditions, and restrictions imposed by applicable Suppliers (as defined in paragraph 8.8 below);
- (e) the winner is solely responsible for the safekeeping of all travel tickets, vouchers, accommodation confirmations, or similar items once received by the winner; any such items which are lost or stolen will not be replaced or reimbursed by us;
- (f) the winner is solely responsible for any expenses, costs, or other travel fees not explicitly included in the prize description for the relevant Competition on the Website;
- (g) the winner and any accompanying guests must travel on the same itinerary unless otherwise expressly approved by us;
- (h) the winner is solely responsible for ensuring that they and their guests possess all necessary travel documents, including valid passports, visas, and any other identification or documentation required for entry into the destination country and re-entry into the departing country;
- (i) any guest under the age of 18 must be accompanied by a parent, legal guardian, or other responsible adult over the age of 18;
- (j) the winner must ensure that they and all guests have adequate travel insurance which fully covers all personal needs related to the trip, including for pre-existing medical conditions, cancellation, lost baggage, medical expenses, and repatriation. The winner warrants that they and their guests are fit to travel. If the winner and their guests partake in adventure sports or other high-risk activities during the trip, then they do so at their own risk and coverage for such activities must be included in their insurance. We accept no liability for any injuries, losses, or damages arising from such activities or inadequate insurance coverage; and
- (k) the winner is solely responsible for ensuring that they and their guests comply with all applicable laws and regulations of the destination country. We disclaim all liability for any violation of local laws or regulations by the winner or their guests.
8.8 A prize may be supplied by a third-party supplier, manufacturer or prize provider (the "Supplier(s)"). Details of the Supplier (if any) will be provided on the Website. Any prizes supplied by a Supplier may be subject to additional terms and conditions of the Supplier, which we will bring to your attention.
8.9 We may offer an alternative cash amount ("Cash Prize") for certain Competitions. If an alternative Cash Prize is offered, the amount of the Cash Prize will be stated in the prize description for the relevant Competition on the Website. It is the winner's choice as to whether or not they take the advertised prize or the alternative Cash Prize and the winner must notify us of their preference to choose the Cash Prize when we contact the winner in accordance with paragraph 9.1 below (otherwise, the advertised prize will be awarded by default). We also reserve the right, in our sole discretion, to substitute any prize for a Cash Prize in the following circumstances:
- (a) the advertised prize becomes unavailable; and/or
- (b) other factors beyond our reasonable control (including those circumstances detailed in paragraph 13.4) make it necessary to do so.
8.10 We may also offer prizes where players can win bundles of entries into certain Competitions. Where such bundle prizes are won, you will be entered into the relevant Competition(s) automatically by us and the Competition(s) that we enter you into will be determined by us in our sole discretion.
8.11 We may also offer Site Credits as prizes, which will be added to your Account and may be used to enter into any Competition of your choosing (subject to any specific instructions or restrictions provided on our Website). Please note that each Site Credit has an expiry date of 18 months from the date that the Site Credit is issued to you. You must use your Site Credits before they expire, as you will no longer be able to use them after the expiry date and your entitlement to them will be voided.
8.12 Each prize must be accepted as awarded and is not negotiable, transferrable, or convertible to other substitutes other than in accordance with the Terms and Conditions and our specific instructions.
9. Claiming the Prize
9.1 We will contact the winner as soon as practicable after the winner has been selected, using the telephone number or email address linked to their Account. If the winner cannot be contacted or has not contacted us to claim the prize within 30 calendar days of the Closing Date, or if we cannot verify that the winner is eligible to receive the prize in accordance with paragraph 10.5 below, their entitlement to the prize will be voided, the prize will remain the property of WTF Giveaways, and we reserve the right to offer the prize to the next eligible Entrant selected at random from the entries that were validly received before the Closing Date. For the avoidance of doubt, we shall incur no liability towards you if your entitlement to any prize is voided in accordance with this paragraph 9.1 or any other provision of the Terms and Conditions.
9.2 You must claim the prize in your personal capacity. The prize may not be claimed by someone else on your behalf.
9.3 Except for prizes that are properties, include travel components, or Cash Prizes:
- (a) Once the winner has validly claimed the prize then we will contact the winner in order to make arrangements for: (i) delivery, where the winner has won a physical item (including electronic goods, fashion items, and merchandise); or (ii) collection on a specified date, where the winner has won a vehicle.
- (b) Where we have agreed to deliver the prize, we will pay the standard costs of delivery in order for the winner to take possession of the prize, however where a prize is not capable of being delivered via standard courier services due to any special delivery requirements stipulated by the winner, the winner will be responsible for any extra costs and expenses related to such requirements.
- (c) If a winner (who has validly claimed a prize) fails to accept the initial attempted delivery of the prize, we can store the prize for 30 calendar days after notifying the winner of the attempted delivery, at the end of which time we will attempt to deliver the prize to the winner again.
- (d) If a winner (who has validly claimed a prize) fails to collect the vehicle on the arranged date, we can store the vehicle for 30 calendar days after notifying the winner of the failed collection, during which time the winner can arrange a second date for collection.
- (e) If the winner fails to accept the delivery or collect the prize a second time for any reason, the prize will remain the property of WTF Giveaways and we reserve the right to offer the prize to the next eligible Entrant selected at random from the entries that were received before the Closing Date. For the avoidance of doubt, we shall incur no liability towards you if your entitlement to any prize is voided in accordance with this paragraph 9.3 or any other provision of the Terms and Conditions.
9.4 Any Cash Prize will be transferred directly to the winner's nominated bank account. The winner must provide evidence that it is the sole or joint beneficiary of the bank account on request. Failure to do so within 14 calendar days of our request will result in the prize being voided. In such circumstances, we reserve the right to offer the prize to the next eligible Entrant selected at random from the entries that were received before the Closing Date.
9.5 We have no responsibility to you and shall incur no liability once a prize has been: (i) delivered to, or collected by, you in accordance with the provisions of paragraph 9.3; (ii) in the case of a prize which is a property, once the transfer of title has been completed; (iii) in the case of a prize which includes a travel component, once the relevant travel ticket(s) and accommodation confirmation(s) have been received by you; or (iv) in the case of a Cash Prize, once the funds have been transferred to your nominated bank account.
9.6 We will always try to award the prize for a Competition to the correct Entrant. However, if, due to reasons of hardware, software or other computer related error, failure, bugs or the unintended operation of any technical systems or software, human error, or due to any other circumstances beyond our reasonable control, the prize is awarded to you incorrectly, we may void your entitlement to the prize and/or reclaim the Competition prize from you and award it to the correct Entrant. If we incorrectly deliver a prize to you or enable you to collect a prize, you are obliged to promptly notify us upon your discovery of the error, take reasonable care of the prize whilst it is in your possession, and return the prize to us (in the same condition in which you received the prize) within 14 calendar days of receiving our return instructions. We will pay your reasonable costs of any such return delivery.
9.7 We do not accept any responsibility and are not liable to pay any compensation if you are unable to or do not take up the prize.
10. Eligibility
10.1 If, following your entry into a Competition or promotion, we have reasonable grounds to believe that you are not eligible, you have become ineligible, or you have not complied with the requirements of this paragraph 10 in any way, then we may terminate our provision of the Services to you, close your Account, disqualify you from entering into any future Competitions or participating in our promotions, or void any entry(ies) made by you and/or any prizes, tickets and/or Site Credits associated with your use of the Services, and no refunds for any entry fees, costs, other fees or expenses incurred, or the return of any Site Credits or promotional offers used, in connection with the same will be given.
10.2 To be eligible to participate in our Competitions and promotions you must be a resident of the United Kingdom and aged 18 years or over.
10.3 Employees of WTF Giveaways, employees of agents or suppliers of WTF Giveaways who are professionally connected with the Competitions or their administration, and members of the immediate families or households of such employees are not eligible to participate in our Competitions.
10.4 By entering any Competition or participating in any of our promotions, you confirm that: (i) you are at least 18 years old; (ii) you are a resident in the United Kingdom; (iii) you have not already registered another Account and/or have previously had an Account which has been suspended or removed from our Website; (iv) the personal details associated with your Account are accurate; (v) you have created an Account solely for your personal benefit and not for anyone else's benefit; and (vi) you are eligible to enter into the relevant Competition(s) (and to claim any prize you may win) in accordance with the Terms and Conditions.
10.5 We may require you to provide documentary evidence and/or other information for us to verify that you are eligible to enter the relevant Competition or participate in our promotions in accordance with the Terms and Conditions. If you are the winner of any Competition or promotion, you may be required to provide information to us as proof of your identity, to confirm your residential address, to confirm your eligibility to enter into the Competition or participate in our promotions, and/or to prove your eligibility to take ownership or possession of the prize.
10.6 We will not accept entries to any Competition or promotion that are:
- (a) automatically generated by computer;
- (b) incomplete or illegible; and/or
- (c) made in a way that breaches the Terms and Conditions.
10.7 By using the Services, you confirm that you are not breaking any laws or regulations applicable to you and/or applicable in the jurisdiction from which you access and use the Services. We do not intend that the Services are used by persons in jurisdictions where such activities are prohibited by applicable law, and we will not be held responsible nor accept any liability for your unlawful use of the Services.
11. Prohibited Activities
11.1 You may only use the Services in accordance with the Terms and Conditions. You acknowledge and accept that you will not, nor will you assist nor encourage anyone else to, engage, or attempt to engage, in any of the following prohibited activities in connection with your use of the Services:
- (a) breaching the Terms and Conditions in a serious way or in a way that you do not, or are unable to, put right within 14 calendar days of us letting you know about this;
- (b) engage in any form of fraudulent, money laundering, improper or illegal activity, or any form of collusion or cheating;
- (c) provide incorrect, inaccurate or misleading information when entering a Competition and/or registering for an Account, make any misrepresentation to us, or conceal any information from us;
- (d) create or use multiple Accounts;
- (e) use the Services from a jurisdiction where it would be unlawful for you to do so, including where you use a VPN to disguise your location to use the Services or access your Account;
- (f) deliberately or accidentally withhold information from us in order to exceed the total number of entries allowed in respect of any Competition (in each case as displayed on the Website);
- (g) hiding your email address when using Apple Pay as a payment method;
- (h) allow someone else to use your Account (whether intentionally or unintentionally) or use or attempt to use another user's Account;
- (i) collect or store any personally identifiable information from other users of the Services;
- (j) tamper with the entry process or the operation of any Competition;
- (k) in our reasonable discretion, engage in any activity which is objectionable, restricts or inhibits any other person from using or enjoying the Services, or may expose us to any harm or liability of any kind or behave in a disruptive manner;
- (l) engage in any abuse and/or harassment of any of WTF Giveaways' directors, shareholders, officers or employees; or
- (m) make any comments (verbally or in writing) about WTF Giveaways or its directors, shareholders, officers or employees, or create any posts or content (including on our social media pages) in relation, or referring, to WTF Giveaways or its directors, shareholders, officers or employees, or any of WTF Giveaways' customers, which is unlawful, infringing, libellous, defamatory, obscene, pornographic, indecent, vulgar, harassing, threatening, violent, invasive of another's privacy or publicity rights, abusive, inflammatory, fraudulent, and/or discriminatory or derogatory of any ethnic, racial, gender, or religious group.
11.2 If you, or you assist or encourage another to, engage in any of the prohibited activities outlined in paragraph 11.1 above and/or if you are disqualified from any Competition or promotion in accordance with the Terms and Conditions, we may terminate our provision of the Services to you, close your Account, disqualify you from entering into any future Competitions or participating in our promotions, or void any entry(ies) made by you and/or any prizes, tickets, and/or Site Credits associated with your use of the Services, and no refunds for any entry fees, costs, other fees or expenses incurred, or the return of any Site Credits or promotional offers used, in connection with the same will be given.
12. Chargeback Policy
12.1 Once your purchase is complete and you receive confirmation of your entry(ies) from us, the transaction is considered final. The product is deemed delivered when you receive this confirmation.
12.2 If you initiate a chargeback or other reversal of payment in respect of any entries you have acquired (and that have not been acquired fraudulently by a third party using a payment method belonging to you) we will immediately suspend your Account. Following your Account suspension, if we (or the relevant acquiring bank) suspect that a chargeback or other reversal of payment request was fraudulent or spurious in any way (including where you falsely contend, contrary to paragraph 12.1, that you have not received confirmation of your entry(ies) from us), we may:
- (a) terminate our provision of the Services to you, close your Account, disqualify you from entering into any future Competitions or participating in our promotions, or void any entry(ies) made by you and/or any prizes, tickets, or Site Credits associated with your use of the Services, and no refunds for any entry fees, costs, other fees or expenses incurred, or the return of any Site Credits or promotional offers used, in connection with the same will be given; and
- (b) take all necessary action to recover any losses we have incurred as a result of such fraudulent or spurious chargebacks or other reversals of payment, including initiating legal proceedings, engaging debt collection agencies, or recovering funds directly from your bank or payment provider.
13. Limitation of Liability
13.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with the Terms and Conditions, we are responsible for the loss or damage you suffer that is a foreseeable result of our breach of the Terms and Conditions or our failing to use reasonable care and skill, but (except as stated in paragraph 13.2 below) we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you accepted the Terms and Conditions, both we and you knew it might happen.
13.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors, or for fraud or fraudulent misrepresentation. Nothing in the Terms and Conditions will affect your statutory rights.
13.3 We are not liable for business losses. Our Competitions, promotions, and Services are not for any commercial, business or resale purpose, and we will have no liability to you for any loss of profit, loss of business or business opportunity, business interruption, or loss of sales or revenue.
13.4 Matters beyond our reasonable control. Except as stated in paragraph 13.2 above, we are not responsible for: (i) any failure or delay on our part to do something promised under the Terms and Conditions if that failure or delay is caused by something outside of our reasonable control (including lightning, flood or severe weather conditions, fire or explosion, pandemic or epidemic, civil disorder, damage or vandalism to our network or equipment, terrorist activities, war, actions of local or national governments or other authorities, or industrial disputes); (ii) any Uninsured Risks; and (iii) any computer, telephone, cable, network, electronic, system, hardware, software, random number generator, or internet malfunctions, failures, bugs, viruses, errors, availability issues, or any deviation from the expected functioning of the Services for whatever reason (unless as a result of our failure to use reasonable skill and care).
13.5 Save as set out in paragraphs 8.5(d) and 13.2 above, our maximum liability to you under the Terms and Conditions whether for breach of contract, tort (including negligence), or otherwise, in relation to any one incident or a series of related incidents, is limited as follows:
- (a) where our liability arises from the loss, deletion, or failure to process your entry, you shall be entitled to a replacement entry into another Competition only; or
- (b) in all other circumstances, £100 (one hundred pounds).
14. Social Media Pages
14.1 We may broadcast the results of any of our Competitions 'live' on our social media pages and on our Website. If you are unable to watch a draw that you have entered, you may request a recorded version by emailing info@wtf-giveaways.co.uk. You acknowledge and accept that we are not able to guarantee that the recorded version will be made available to you because we rely on third-party platforms to make it available to us. We are not responsible or liable to you for any failure or delay in providing the recorded version of any live broadcast.
14.2 We are not responsible or liable for:
- (a) the accuracy, reliability, completeness, veracity or suitability of any comments or other content posted on social media in relation to, or in connection with, WTF Giveaways, the Website or the Services;
- (b) the actions of any group members, moderators or employees of WTF Giveaways in or on our social media pages, groups or accounts. You should always check the Website, the Terms and Conditions and any additional information available on the Website before deciding if you want to participate in any of our Competitions or promotions and you should not accept information on our social media pages or groups to be accurate; or
- (c) verifying the identity of any party posting a comment on social media in relation to WTF Giveaways, the Website and/or the Services including on any of our social media pages, groups or accounts.
14.3 The Competitions are in no way sponsored, endorsed, administered by or associated with Facebook, Instagram, TikTok, WhatsApp, or any other social media platform on which they appear. By entering the Competitions, you agree that no social media platform has liability to you and they are not responsible for the administration or promotion of the Competitions.
14.4 We may remove you from any of our social media pages, groups or accounts in our sole discretion.
15. Data Protection and Publicity
15.1 We will only use your personal information as set out in our Privacy Notice. This explains what personal information we collect from you, how and why we collect, store, use, and share such information, your rights in relation to your personal information, and how to contact us and the relevant supervisory authority if you have a query or complaint about the use of your personal information.
15.2 If you are the winner of a Competition or promotion, we will ask to use your name, image, and town or county of residence to participate in any reasonable publicity required by us.
16. General
16.1 Disputes: The Terms and Conditions, their subject matter and their formation, are governed by English law. Wherever you live in the United Kingdom, you can bring claims against us in the English courts. If you live in Scotland, Wales or Northern Ireland, then you can also bring claims against us in the courts of the country you live in. We can also claim against you in the courts of the country you live in.
16.2 WTF Giveaways makes no representations and gives no warranties in respect of any information provided on the Website, and will not be liable to you if the information provided on the Website is not accurate, complete or up to date.
16.3 The Terms and Conditions are between you and us only. No one other than you or us has any right to enforce any of the Terms and Conditions.
16.4 We may transfer our rights and obligations under the Terms and Conditions to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the Terms and Conditions.
16.5 If a court finds any provision of the Terms and Conditions unlawful, the other provisions will continue in force. Each paragraph in the Terms and Conditions operates separately. If any court or relevant authority decides that any of them is unlawful, the other paragraphs will remain in full force and effect.
16.6 Even if we delay in enforcing our rights under the Terms and Conditions, we can still do so later. If we do not insist immediately that you do anything you are required to do under the Terms and Conditions, or if we delay in taking steps against you in respect of your breach of the Terms and Conditions, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
16.7 Interpretation: The headings used in the Terms and Conditions are for convenience only and have no legal or contractual effect. Use of the word "including" will be interpreted to mean "including without limitation".
